Service: Lodgeck platform (lodgeck.com) and the Lodgeck Report™ product suite (collectively, the “Platform”)
1. Acceptance of Terms
By accessing or using the Lodgeck Platform or purchasing a Lodgeck Report, you agree to be bound by these Terms of Service. If you do not agree, do not access or use the Platform.
2. Nature of Service & Critical Disclaimers
A. Not Title Insurance or Legal Opinion
Lodgeck LLC is an automated data aggregation service. Reports provide indexed information obtained from public records for informational and preliminary auditing purposes only. They do not eliminate the necessity of formal municipal lien letters, surveys, or title insurance commitments issued by a licensed title agent or underwriter.
B. Public Record Accuracy
All data presented in a Lodgeck Report is retrieved from publicly accessible county, municipal, and state government databases. Lodgeck LLC exercises no control over government record-keeping and is not responsible for unrecorded encumbrances, misindexed instruments, municipal utility lag times, or typographical errors originating within official government repositories.
3. User Accounts & Security
- You must provide accurate, current, and complete information during registration.
- You are responsible for safeguarding your credentials and session tokens. You must notify support@lodgeck.com immediately upon discovering any unauthorized account activity.
4. Billing, Credits & Account Balance
- Report Credits: Pay-as-you-go search credits and subscriptions are billed through our authorized payment processors.
- Balance-First Application: Any positive balance earned via the Lodgeck Affiliate Program will automatically apply to new search purchases and renewal fees before charging payment methods on file.
- Refund Policy: Search credits consumed to initiate an automated public records examination are non-refundable once data processing has commenced, regardless of whether records/liens are found on the queried property.
5. Affiliate Program & Payouts
- Commission tiers are granted according to the current platform affiliate schedule.
- Payout requests are subject to verification and review by Lodgeck LLC. We reserve the right to withhold disbursements if referrals are generated via fraudulent activity, self-referral loops, or spamming practices.
